NexNet
Introduction
These Commercial Terms and Conditions apply to all business, enterprise, and commercial customers of NexNet, including use of the NexNet customer portal, the purchase or lease of equipment, and the supply of internet and related services. By ordering, accessing, or using NexNet services, equipment, or the NexNet Portal, you agree to be bound by these Terms and Conditions.
Definitions
NexNet means NexNet, a business operated by CDI Technical Group PTY LTD.
Customer means the business, organisation, or entity acquiring services or equipment from NexNet.
Services means internet access services, managed network services, monitoring services, and any related services supplied by NexNet.
Equipment means any hardware supplied, sold, leased, or managed by NexNet, including routers, modems, firewalls, wireless access points, and monitoring devices.
Portal means the NexNet customer portal and any associated dashboards, tools, or interfaces.
nbn® means the National Broadband Network and associated wholesale providers.
Scope of Services
NexNet supplies commercial internet connectivity and related services, which may include NBN services, fixed wireless, satellite services, bonded or failover connections, managed Wi-Fi, network monitoring, and managed network services. Service availability, performance, and technology type depend on location, infrastructure, and third-party providers.
Use of the NexNet Portal
The NexNet Portal is provided to allow customers to view service information, manage accounts, access billing, lodge support requests, and monitor services. Access credentials are issued for authorised users only. Customers are responsible for maintaining the security of portal credentials and for all actions taken using their login details. NexNet may modify, suspend, or restrict portal access for maintenance, security, or misuse.
Acceptable Use
Customers must use NexNet services and equipment lawfully and in accordance with all applicable laws and regulations. Services must not be used for unlawful activities, network abuse, interference with other users, or activities that compromise network integrity or security. NexNet may suspend or restrict services where misuse or unacceptable use is detected.
Equipment Supply and Ownership
Equipment supplied by NexNet may be sold, leased, or provided on a managed basis depending on the service agreement. Ownership of sold equipment transfers upon full payment. Leased or managed equipment remains the property of NexNet and must not be modified, resold, or transferred without consent. Customers are responsible for the care, protection, and proper use of all equipment while in their possession.
Installation and Site Requirements
Customers must provide suitable access, power, and environment for installation and operation of services and equipment. NexNet is not responsible for delays or failures caused by site conditions, third-party infrastructure, or access restrictions. Installation dates are indicative only and may change.
Fees and Charges
All fees are as agreed at the time of order or as published by NexNet. Charges may include monthly service fees, usage charges, installation costs, hardware costs, shipping fees, and third-party charges such as nbn® fees. Prices are exclusive of GST unless stated otherwise.
Billing and Payment
Invoices are issued in advance unless otherwise agreed. Payment is due by the date specified on the invoice. NexNet may suspend services for overdue accounts. Interest, late fees, or recovery costs may apply where payment is not made on time.
Service Levels and Availability
NexNet will use reasonable efforts to provide reliable services but does not guarantee uninterrupted service, minimum speeds, or fault-free operation. Services may be affected by maintenance, upgrades, outages, or third-party infrastructure. NexNet is not liable for losses arising from service interruptions except where required by law.
Managed Services and Monitoring
Where managed or monitored services are provided, NexNet may access customer equipment and networks remotely for monitoring, maintenance, and support purposes. These services aim to improve reliability but do not guarantee prevention of all faults, outages, or security incidents.
Changes to Services
NexNet may change, upgrade, or modify services, equipment, or pricing where reasonably required. Material changes will be communicated where practicable.
Limitation of Liability
To the maximum extent permitted by law, NexNet excludes liability for indirect, incidental, or consequential loss, loss of profits, business interruption, or data loss. NexNet’s liability is limited to the re-supply of services or the cost of re-supply, except where consumer guarantees apply and cannot be excluded.
Privacy and Data
NexNet handles personal and business information in accordance with its Privacy Policy and applicable privacy legislation. Customers consent to data collection and processing necessary to deliver services.
Termination
Either party may terminate services in accordance with the agreed service terms. NexNet may suspend or terminate services immediately for non-payment, breach of these Terms, or unlawful use. Upon termination, customers must return any NexNet-owned equipment.
Force Majeure
NexNet is not liable for failure to perform due to events beyond its reasonable control, including natural disasters, network failures, power outages, or actions of third parties.
Governing Law
These Terms and Conditions are governed by the laws of Western Australia and the Commonwealth of Australia. The parties submit to the jurisdiction of Australian courts.
